For the purposes of the EU General Data Protection Regulation (GDPR), AIVERGENT acts as the data controller for personal data collected through this website.

2. What data we collect

We collect personal data only when you actively provide it to us.

 

Specifically:

Contact form submissions. When you fill out our contact form or send us an email, we collect:

  • Your name

  • Your email address

  • Any information you choose to include in your message (company, role, project context)

Website usage data. When you visit our website, we automatically collect:

  • IP address (anonymized)

  • Browser type and version

  • Pages visited and time spent

  • Referring source

  • Device type

This data is collected through cookies and analytics tools (see Section 5).

We do not collect:

  • Sensitive personal data (health, religion, political opinions, etc.)

  • Payment information (we do not process payments through this website)

  • Data from minors under 16

3. Why we collect it (legal basis)

Contact form data - to respond to your inquiry, qualify leads, and discuss potential engagements. Legal basis: legitimate interest (GDPR Art. 6(1)(f)) and consent where applicable.

Website usage data - to improve our website, understand visitor behavior, and ensure technical functionality. Legal basis: consent for non-essential cookies (GDPR Art. 6(1)(a)); legitimate interest for essential cookies and security.

4. How long we keep it

  • Contact inquiries: Up to 24 months after our last interaction, unless you request earlier deletion or our engagement becomes a long-term business relationship requiring longer retention for legal or tax purposes

  • Cookie data: As specified per cookie type (see Section 5)

  • Email communications: Retained for the duration of business relationship plus statutory retention periods under Romanian commercial and tax law (typically 5–10 years for invoiced services)

5. Cookies

  • We use cookies and similar tracking technologies on this website. Specifically:

  • Strictly necessary cookies (always active): Required for the website to function. Cannot be disabled. No personal data is collected through these.

  • Analytics cookies (consent required): We use Google Analytics to understand how visitors use our website. This helps us improve content and structure. Data is processed by Google in accordance with their privacy practices.

  • You can manage your cookie preferences at any time through the cookie banner or by clicking "Cookie Settings" in the footer.

6. Who we share data with

  • We do not sell, rent, or trade your personal data.

  • We may share data with the following categories of recipients, only as strictly necessary:

  • Hosting and infrastructure providers — Wix.com Ltd., for website hosting and infrastructure

  • Email providers — for sending and receiving correspondence

  • Analytics providers — Google (Google Analytics)

  • Legal authorities — only when required by law

  • All third parties processing data on our behalf are bound by data processing agreements compliant with GDPR.

  • If we engage you in a project or partnership, additional data sharing may occur based on the engagement scope. This will be governed by separate written agreements at that point.

  • Some of our service providers (Google, Wix) operate outside the European Economic Area (EEA). When personal data is transferred outside the EEA, we rely on:

  • Standard Contractual Clauses (SCCs) approved by the European Commission, or

  • Adequacy decisions by the European Commission, or

  • Other safeguards permitted under GDPR Chapter V

  • Right of access — request a copy of the data we hold about you

  • Right to rectification — correct inaccurate or incomplete data

  • Right to erasure ("right to be forgotten") — request deletion under specific conditions

  • Right to restrict processing — limit how we use your data

  • Right to data portability — receive your data in a structured, machine-readable format

  • Right to object — object to processing based on legitimate interest

  • Right to withdraw consent — at any time, where consent was the legal basis

  • Right to lodge a complaint with the Romanian Data Protection Authority (ANSPDCP — Autoritatea Națională de Supraveghere a Prelucrării Datelor cu Caracter Personal) at www.dataprotection.ro

  • To exercise any of these rights, email contact@aivergent.com. We will respond within 30 days as required by GDPR.

9. Security

We take reasonable technical and organizational measures to protect your personal data against accidental loss, unauthorized access, alteration, and disclosure. These include encryption in transit (HTTPS), access controls, and regular security reviews of our service providers.

However, no method of internet transmission or electronic storage is 100% secure. We cannot guarantee absolute security.

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or website features. The "Last updated" date at the top of this policy reflects when changes were made. Material changes will be communicated via the website or, where appropriate, via email.
